Filing a Roof Insurance Claim in Georgia: What Every Homeowner Should Know

After a storm moves through Fayetteville, Peachtree City or Newnan, the first question many homeowners ask is: will insurance cover my roof? Georgia has specific laws that protect you during the claim process. Knowing them helps you avoid scams, delays and costly mistakes. This guide is for general education only; always confirm details with your insurance agent and your own policy.

Step 1: Protect your home and family first

If water is coming inside, move valuables away from the leak, catch drips with buckets, and call a roofer for an emergency tarp. Keep every receipt for temporary repairs. Most homeowners policies expect you to take reasonable steps to prevent additional damage after a storm.

Step 2: Document the damage

  • Take date-stamped photos from the ground of your roof, gutters, downspouts and siding.

  • Photograph ceiling stains, wet insulation or drips inside the home.

  • Look for hail signs on soft metals: dented gutters, downspouts, AC fins, mailboxes and vents.

  • Write down the date and approximate time of the storm and save any weather alerts you received.

  • Do not climb onto the roof yourself. Wet or damaged shingles are dangerous.

Step 3: Contact your insurance company

Report the damage promptly and follow your insurer's instructions. While you are on the phone, ask three important questions:

  • Do I have a separate wind or hail deductible? Many Georgia policies do, and some are a percentage of your home's insured value rather than a flat dollar amount.

  • Is my roof covered at Replacement Cost Value (RCV) or Actual Cash Value (ACV)?

  • Is there a deadline for filing or for completing repairs under my policy?

RCV vs. ACV in plain language

With Replacement Cost Value coverage, your insurer typically pays in two parts: a first check for the depreciated value, then the held-back depreciation once the work is finished and invoiced. With Actual Cash Value coverage, you are paid only the depreciated value of your roof, so an older roof can receive much less. Your deductible is subtracted either way.

Georgia laws that protect homeowners

You can cancel a roofing contract if your claim is denied

Under O.C.G.A. § 10-1-393.12, if you sign a contract with a residential roofer that will be paid from insurance proceeds, you may cancel it before midnight on the fifth business day after your insurer notifies you in writing that all or part of the claim was denied. The contractor may still charge for emergency work you approved in writing to prevent further damage.

A roofer cannot negotiate your claim

The same law says a residential roofing contractor may not represent you or negotiate with your insurer on your behalf. Only a licensed public adjuster can do that. A good roofer can still inspect, document damage, and be on site during the adjuster's visit to point out what was found.

No one can pay or “waive” your deductible

Georgia's House Bill 423 makes it illegal for contractors to advertise or promise to pay or rebate any part of your insurance deductible, including disguised offers like discounts for placing a yard sign. The Georgia Insurance Commissioner's office has warned that deductible-waiver schemes can amount to insurance fraud, which puts the homeowner at risk too.

Red flags after a storm

  • A door-to-door salesperson who offers to “cover your deductible” or promises a “free roof.”

  • Pressure to sign a contract the same day, before an inspection or an adjuster visit.

  • No local office address, no Georgia references, or out-of-state license plates.

  • Requests for full payment up front or to sign over your insurance check before any work begins.

  • Vague, one-line estimates with no materials or scope listed.
